Terms of Service

1. Agreement to Terms

By accessing or using ABA Notes Pro at abatoolsrpd.com or the ABA Tools RPD mobile application (collectively, "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

2. Description of Service

ABA Notes Pro is a documentation assistance tool designed for Applied Behavior Analysis (ABA) professionals, including Registered Behavior Technicians (RBTs), Board Certified Behavior Analysts (BCBAs), and other ABA practitioners. The Service enables users to:

Enter and store ABC (Antecedent-Behavior-Consequence) session data
Manage client profiles and behavioral goals
Generate professional session notes from entered data
Export notes as PDF documents

3. Important Disclaimer — Professional Responsibility

ABA Notes Pro is a documentation assistance tool, not a substitute for professional clinical judgment.

All generated session notes must be reviewed, verified, and approved by a qualified clinician before submission or use.
You are solely responsible for the accuracy and clinical appropriateness of all documentation submitted under your name or credentials.
ABA Notes Pro makes no representations that generated notes meet any particular regulatory, billing, or clinical standard.
The Service does not provide clinical advice, diagnosis, or treatment recommendations.
Session notes are generated using artificial intelligence (AI). AI-generated content may contain errors and must be thoroughly reviewed before use.
You acknowledge that AI-generated notes are documentation aids and the final responsibility for clinical accuracy rests with the signing clinician.

4. Account Registration

To use the Service, you must create an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your password
Notify us immediately of any unauthorized use of your account
Accept responsibility for all activity that occurs under your account

You must be at least 18 years of age to create an account.

5. Credits and Payments

The Service operates on a credit-based system. Each session note generation consumes one (1) credit.

Free Credits: New accounts receive 4 complimentary credits upon registration.
Purchasing Credits: Additional credits may be purchased through the Service at the rates listed on our pricing page. All prices are in US Dollars.
No Refunds: All credit purchases are final and non-refundable. Credits do not expire.
Payment Processing (Web): Payments on the website are processed securely by Stripe. We do not store your payment card information.
Payment Processing (iOS App): In-app purchases on iOS are processed by Apple through the App Store. Payment will be charged to your Apple ID account at confirmation of purchase. Apple's terms and refund policies apply to all App Store purchases.
Quick Notes: Quick Note generation consumes two (2) credits. Manual note generation consumes one (1) credit.

6. Referral Program

We offer a referral program through which you may earn commission on purchases made by users you refer. By participating:

You earn 20% of the purchase price of each credit package purchased by a referred user, for as long as they remain a customer.
Referral commissions are tracked as a cash balance in your account.
Payouts are processed manually upon request to contact@abatoolsrpd.com.
We reserve the right to modify or terminate the referral program at any time with notice to participants.
Referral abuse (fake accounts, self-referrals) will result in forfeiture of commissions and account termination.

7. Acceptable Use

You agree not to use the Service to:

Enter false, fabricated, or fraudulent clinical data
Create documentation for sessions that did not occur
Violate any applicable laws, regulations, or professional ethical standards
Submit documentation under credentials you do not hold
Reverse engineer, scrape, or attempt to extract data from the Service
Share your account with unauthorized users
Use the Service for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these terms.

8. Your Data and Privacy

You retain ownership of all data you enter into the Service. By using the Service, you grant us a limited license to store and process your data solely for the purpose of providing the Service to you.

We will not sell your data to third parties. See our Privacy Policy for full details on how we handle your information.

9. Intellectual Property

The ABA Notes Pro platform, including its software, design, and content (excluding your data), is owned by ABA Notes Pro and protected by applicable intellectual property laws. You may not copy, modify, or distribute the platform or its components.

10. Limitation of Liability

To the fullest extent permitted by law, ABA Notes Pro shall not be liable for:

Any errors in generated notes or documentation
Regulatory, billing, or compliance issues arising from use of the Service
Loss of data, revenue, or business opportunities
Any indirect, incidental, or consequential damages arising from use of the Service

Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

You may close your account at any time through the app (Settings → Delete Account) or by contacting us at contact@abatoolsrpd.com. Account deletion permanently removes all your data. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable upon termination.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the applicable courts.
